Every Town in Ocean County That Hires Gilmore Law Firm Has Been Subpoenaed by Feds, Attorney Cipriani Confirms

LITTLE EGG HARBOR – Jean Cipriani, a partner in the Gilmore & Monahan firm, confirmed at Thursday night’s township committee meeting that every town in Ocean County that hires the law firm of Ocean County Republican Chairman George has been served with subpoenas in connection with the ongoing federal investigation into Gilmore.

“A Bunch Of Subpoenas”

When questioned by a resident at Thursday night’s Little Egg Harbor Township Committee meeting, the Gilmore firm’s Jean Cipriani said that all towns in Ocean County that hire her firm have been subpoenaed in connection with the FBI investigation into Mr. Gilmore

“There were subpoenas issued to all the towns in Ocean County,” Cipriani said at the public meeting. “I believe it’s all the towns,  but certainly I am aware of a bunch of them that our firm represents and they were subpoenaed.”

Those subpoenas were all identical to the one served on Little Egg Harbor earlier this week, which we reported on earlier Thursday.

Cipriani said the subpoenas demanded  contracts, resolutions, legal bills and minutes of meetings where a member of the firm was present.

The towns that hire Gilmore’s firm include the following, which were also subpoenaed:

  • Lacey
  • Little Egg Harbor
  • Bay Head
  • Berkeley
  • Jackson
  • Plumsted
  • Seaside Heights
  • Lakewood

Question can you OPRA the subpoenas?
I for one would think it would make for some interested reading since Ms Cipriani confirmed it.
I would think the sale of depends adult diapers has increased all over Ocean County

    • Yes, the subpoenas can be obtained under OPRA. Any record that is made, maintained, kept on file or received in the course of business is presumed to be a public record subject to disclosure unless and until the public entity can raise one of the 24 exemptions from disclosure. As a legal document served on them from the courts, both subpoenas ad testificadum and duces tecum are public records. I like to get legal documents via OPRA because it’s a lot quicker than going through the courts directly, since OPRA doesn’t apply to either state or federal courts. You could also file a federal FOIA request to get them from the feds, but that could take as long as 20 days, OPRA requires a 7 business day response. I posted the one from Little Egg Harbor in the comment thread on one of the other articles here. The ones that were served to Lacey and elsewhere are identical.
